Anti-Money Laundering and Counter Terrorism Financing (AML/CTF) rules and Client Due Diligence Checks (CDD)

From 1 July 2026, new federal laws will require our business, along with many other professional service providers such as accountants, financial advisors, lenders or real estate agents, to comply with Australia’s Anti-Money Laundering and Counter Terrorism Financing (AML/CTF) rules.

In order to comply with the AML/CTF rules, all regulated businesses will be required to complete Client Due Diligence Checks (CDD) and Client Risk Assessments, before providing a designated legal/conveyancing service. Thes CDD checks include, but are not limited to:

Verifying the identity of our clients.
Collecting information about the source of the funds for transactions or matters.
Confirming ownership and control of any entity such as company, trust or self-managed superannuation fund (SMSF) involved in a transaction or matter.

In line with the AML/CTF rules, CDD checks and the completion of Client Risk Assessments are mandatory, and we are legally required to complete these checks before we can provide any designated legal/conveyancing service. Failure to provide the necessary information for these checks to be undertaken may mean that we are unable to proceed with a transaction or matter.

Based on our own internal risk management strategies, we will be undertaking a verification of identity check (VOI) on all clients under the (AML/CTF) rules.

Fees and charges relating to our client onboarding for CDD and Risk Assessment procedures is $45.00 (including GST) per person and is managed by our office and our third-party provider Infortrack.

If you have any questions regarding our requirements under the Anti-Money Laundering and Counter Terrorism Financing (AML/CTF) rules and Client Due Diligence Checks (CDD) please contact our office.
